
Rivers State Governor, Mr. Chibuike Amaechi has asked a Port Harcourt High court to issue an order restraining the Rivers State House of Assembly from making impeachment moves against him and prevent all 32 Members of the Assembly from suspending him unconstitutionally.
Governor Amaechi in a suit filed by his counsel is asking that his tenure (due to end in 2015) should not be unconstitutionally interrupted by any of the factions of the Assembly. The factions include both the 27 lawmakers loyal to him and the 5 others considered anti-Amaechi. The trial Judge, Justice George Omereji, however adjourned hearing on the matter to June 18, 2013.
Meanwhile Counsel to the state assembly Barrister Emenike Ebete told LEGISREPORTS that he has filed an application opposing the governor’s motion. “The Governor approached the court against the Rivers State House of Assembly and 32 members and prayed the court to restrain the assembly who are my clients to restrain them from impeaching him illegally or unconstitutionally or the two third of the House to want to illegally impeach him without following due process, so he approached the court that they should not impeach him illegally except as provided for constitutionally” he said.
Meanwhile leader of the assembly, Hon. Chidi Lloyd while reacting to the development told LEGISREPORTS that the governor has absolute right to seek protection of the court. “Yes, the governor is right to pursue that cause of action, especially with the purported inducement of members with oil wells and the threat of the five rebels. He is absolutely within his right,” he said.
